In the first case to reach #SCOTUS arising from the blitz of actions taken in the early weeks of the new admin, lawyers for #Trump asked the justices on Sunday to let him fire a govt lawyer who leads a #watchdog agency.
The admin’s emergency application asked the #SupremeCourt to vacate a federal trial judge’s order temporarily reinstating Hampton Dellinger, the head of the Office of #SpecialCounsel.
Dellinger leads an #independent agency charged w/ #safeguarding government #WhistleBlowers & enforcing certain #ethics laws. The position is unrelated to special counsels appointed by the #DOJ.
“This court should not allow lower courts to seize #ExecutivePower by dictating to the president how long he must continue employing an agency head against his will,” the administration’s filing said.

@Nonilex Sadly, this will probably go badly for the Special Counsel. It would have been a stronger situation if the OSC were under the MSPB, as originally envisioned. But when the OSC was removed and made independent of the MSPB, it became far more similar to the CFPB in its structure as a single-headed agency, making removal protections far less viable.
